2. About This Prize Draw
2.1 This prize draw has been organised by Leigh Thurston as a personal fundraiser in memory of family members, who were cared for at Foyle Hospice.
2.2 This prize draw is intended to operate as a free-entry prize draw in accordance with the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985 as amended (“the 1985 Order”). A genuine free entry route is available to all eligible participants; see Clause 4. Where this draw is promoted online or via social media, it is also subject to the advertising codes of the Committee of Advertising Practice (CAP) as enforced by the Advertising Standards Authority (ASA).
2.3 The Promoter intends that this draw shall be operated in compliance with the 1985 Order. Nothing in these Terms and Conditions shall require the draw to be operated in a manner inconsistent with applicable law.
3. Online Entry
3.1 The draw opens on the date of publication on the Foyle Hospice website and closes at 17:00 on Wednesday 29th April 2026 for all entries (the “Closing Date”). All paid online entries and all free postal entries must be received by the Promoter by this time. One entry per postcard only. Hand-delivered entries will not be accepted. 5. Eligibility
5.1 This prize draw is open to residents of the United Kingdom aged 18 years or over at the date of entry.
5.2 The following persons are not eligible to enter:
• Leigh Thurston (the Promoter) and members of his immediate family
• Employees of the fundraising department at Foyle Hospice
• Any person professionally connected with the administration of this draw
5.3 By entering, you confirm that you are eligible to enter and eligible to claim any prize you may win. The Promoter may request proof of eligibility at any time. Failure to provide such proof within a reasonable period may result in disqualification.
5.4 Age verification is required at the point of online entry. The Foyle Hospice website prevents any person from adding entries to their basket unless they confirm their date of birth and indicate that they are aged 18 or over. The Promoter additionally reserves the right to require documentary proof of age from any winner prior to the award of a prize. Any entrant found to be under 18 at the time of entry will be disqualified and any prize forfeited.
5.5 Entries generated by automated means, computer scripts, or any other non-human process will be disqualified.
6. The Draw
6.1 The draw will take place on Friday 1st May 2026 (the “Draw Date”).
6.2 The draw will be conducted by the Promoter, Leigh Thurston, in the presence of a representative of Foyle Hospice and at least one independent witness.
6.3 Winners will be selected by a verifiably random process. The draw will be witnessed and documented.
6.4 Each prize will be drawn separately. An entrant may win more than one prize unless otherwise stated.
6.5 The decision of the Promoter is final. No correspondence or discussion will be entered into regarding the conduct or outcome of the draw.
6.6 The draw results will be published on the Foyle Hospice website and Leigh Thurston’s social media channels following the draw, in accordance with Clause 8.6.
7. The Prizes
7.1 The prizes for this draw are those listed on the relevant Leigh Thurston – In Memory Fundraising prize draw page on the Foyle Hospice website as published on the Effective Date, and that prize list is incorporated into these Terms and Conditions by reference.
7.2 All prizes have been donated by third-party businesses and are subject to availability. Prize details are correct at the time of publication. The Promoter reserves the right to substitute any prize with a prize of equal or greater value if a donated prize becomes unavailable for any reason outside the Promoter’s control.
7.3 Prizes are non-transferable and non-exchangeable. No cash alternative will be offered unless stated.
7.4 Prize values stated are approximate and based on information provided by the donating businesses. The Promoter makes no warranty as to the accuracy of stated values.
7.5 Winners are responsible for all travel and ancillary costs associated with redeeming or using their prize after it has been awarded. The prize is the experience or voucher as described only. Travel, accommodation (where not included in the prize), and any other associated costs are the winner’s sole responsibility.
7.6 Where prizes include experiences outside Northern Ireland, winners are responsible for compliance with all applicable entry requirements, travel arrangements, and any associated costs.
7.7 All prize vouchers and experiences are subject to the terms and conditions of the relevant donating business. The Promoter accepts no liability for any issue arising from the redemption or use of a prize by the winner.
7.8 Prizes must be claimed within 28 days of notification. Failure to claim within this period may result in the prize being forfeited and awarded to the next eligible entrant selected from the draw.
8. Notification of Winners
8.1 The Promoter will contact winners as soon as practicable after the Draw Date using the contact details provided at the time of entry.
8.2 If a winner cannot be contacted within 14 days of the Draw Date, or fails to claim their prize within 28 days of notification, the Promoter reserves the right to award the prize to the next eligible entrant selected from the draw.
8.3 Winners may be required to provide proof of identity and proof of age before a prize is awarded.
8.4 It is the entrant’s responsibility to ensure that the contact details provided at the time of entry remain accurate. If your personal details, including contact information, change at any time after entry, you must notify the Promoter as soon as reasonably possible by emailing fundraising@foylehospice.com or writing to the Foyle Hospice Fundraising Office, 61 Culmore Road, Derry~Londonderry, BT48 8JE. Notifications must include the competition name, your old details, and your new details. If your contact details change within 10 days of the Closing Date, the Promoter will use the most recent details reasonably available to it at the relevant time.
8.5 All prizes must be claimed by the winner personally. The Promoter may require the winner to provide reasonable evidence of identity and age before a prize is released. Wherever reasonably practicable, verification will be carried out remotely. A winner will not be required to incur a cost simply to claim a prize, save for any ordinary cost of responding by standard rate post, standard rate telephone call, or email. Where a prize donor requires in-person attendance to redeem or use an experience, that requirement relates to redemption or use of the prize and not to claiming the prize itself.
8.6 The surname and county of major prize winners may be published on the Foyle Hospice website and Leigh Thurston’s social media channels, or otherwise made available, in order to demonstrate that the draw was properly conducted. If you object to all or part of that information being published or made available, you must notify the Promoter before the Closing Date. In such circumstances, the Promoter may still disclose relevant winner information to the Advertising Standards Authority or any other regulator on request.
9. Entry Fees
9.1 Except where a refund is required by law, or where there has been a duplicate payment, processing error, or cancellation of the draw, entry fees for valid online entries are non-refundable once processed. If you believe an error has occurred in connection with your entry, please contact the Foyle Hospice Fundraising Office at 61 Culmore Road, Derry~Londonderry, BT48 8JE or by email at fundraising@foylehospice.com as soon as possible and your query will be considered on its merits.
9.2 No refund will ordinarily be given where an entrant is later found to be ineligible, is disqualified for any reason, or where the draw proceeds but the entrant does not win a prize, save where a refund is required by law or where the Promoter determines that a refund is appropriate in the particular circumstances.
9.3 Given the fundraising nature of this draw, the net proceeds of online entries, after deduction only of card processing charges applied by the payment merchant, are donated to Foyle Hospice. By paying for online entry, entrants acknowledge that the majority of the amount paid is intended to support Foyle Hospice as well as to secure entry into the draw.
10. Disqualification and Fraud
10.1 The Promoter reserves the right to disqualify any entrant who:
• Provides false, inaccurate, or misleading information at the time of entry
• Is found to be under the age of 18
• Is found to be ineligible under Clause 5
• Engages in any form of fraud, fraudulent misrepresentation, or fraudulent concealment
• Attempts to interfere with or manipulate the draw or its administration
• Behaves in a manner that is abusive, threatening, or offensive toward the Promoter, Foyle Hospice staff, or any person associated with the draw
10.2 Disqualified entries will be declared void. Entry fees are non-refundable in such circumstances, save where a refund is required by law. Any queries should be directed to the Foyle Hospice Fundraising Office.
11. Cancellation and Amendments
11.1 The Promoter reserves the right to cancel, suspend, or amend this prize draw where it becomes necessary to do so due to circumstances beyond their reasonable control. In such circumstances, the Promoter will give as much notice as possible via the Foyle Hospice website and social media channels. If the draw is cancelled before the Draw Date, paid online entrants will be refunded in accordance with Clause 9.
11.2 The Promoter will not cancel the draw solely due to a lower than anticipated number of entries being received. The draw will proceed on the Draw Date regardless of the number of entries received.
11.3 The Promoter will not extend the Closing Date of this draw simply to sell more entries. Any extension to the Closing Date will only be made where genuinely necessary and will be communicated via the Foyle Hospice website and social media channels with reasonable notice.
11.4 The Promoter reserves the right to amend these Terms and Conditions only where necessary to comply with applicable law, to reflect circumstances outside the Promoter’s reasonable control, to correct obvious errors or omissions, or to address fraud, abuse, security, or technical issues. No amendment will materially disadvantage entrants who have already entered. Any amendment will be published on the Foyle Hospice website as soon as reasonably practicable.
12. Data Protection and Privacy
12.1 Personal information provided by entrants in connection with this prize draw will be processed by Leigh Thurston and Foyle Hospice as joint controllers for the purposes of administering the draw, verifying eligibility, contacting winners, awarding prizes, dealing with queries and complaints, maintaining an audit trail of the draw, and complying with legal and regulatory obligations.
12.2 The lawful bases relied upon for this processing are that it is necessary for the administration of the prize draw arrangement with entrants, for the legitimate interests of operating a lawful and transparent fundraising prize draw, and, where applicable, for compliance with legal obligations. Personal data will not be used for marketing purposes by Leigh Thurston or Foyle Hospice unless you have separately consented to that use.
12.3 Personal data may be shared with payment processors, website and technology service providers, prize donors where reasonably necessary to fulfil a prize, professional advisers, insurers, regulators, and law enforcement or other authorities where required by law or where reasonably necessary to protect the integrity of the draw.

12.5 Winner details may be published or made available as described in Clause 8.6.
13. Social Media

Any material inviting paid online entry will also state clearly that a free postal entry route is available and will direct entrants to the relevant webpage or these Terms and Conditions for full details.
13.2 This prize draw is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, X, TikTok, or any other social media platform. By entering, entrants agree that no social media platform bears any liability for the administration or promotion of this draw.
14. Limitation of Liability
14.1 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited.
14.2 Subject to Clause 14.1, the Promoter and Foyle Hospice will not be responsible for loss, damage, or delay caused by events outside their reasonable control, technical failures affecting the transmission of entries, or acts or omissions of third-party prize suppliers, provided that nothing in this clause affects any liability arising from the Promoter’s or Foyle Hospice’s own negligence or breach of law.
14.3 Your statutory rights are not affected.

Foyle Hospice complies with all applicable charity law, financial regulation, and anti-money laundering requirements in its capacity as fund holder. All such net funds received are applied for use for Foyle Hospice.
